These Terms of Service ("Terms") are an agreement between you and Articol Creative, Inc., a Texas corporation ("Articol Creative," "we," "us," or "our"). They govern your access to and use of our website at thearticol.com, our online store, our client portals, and any related pages, tools, or services we offer (together, the "Platform"). By using the Platform, placing an order, or submitting information to us, you agree to these Terms. If you do not agree, please do not use the Platform.
Articol Creative is a creative studio offering brand identity, design, photography, video, and related creative services, along with a members-only online store and private client portals. Some areas of the Platform require an invitation or a login.
You must be at least 18 years old, or the age of majority where you live, to make a purchase or enter into an agreement with us. By using the Platform you confirm that you meet this requirement and that the information you give us is accurate.
Certain areas use a login (for example, an emailed access code). You are responsible for keeping your access secure and for activity that occurs under your access. Tell us promptly at info@thearticol.com if you believe your access has been used without your permission.
Prices are shown in U.S. dollars and may change at any time before you complete a purchase. We may correct pricing or description errors and cancel affected orders, even after an order is placed, and we will refund any amount charged for a cancelled order. Payments are processed by our third-party payment processor. We do not receive or store your full card details.
Some items may be offered as pre-orders. Pre-orders are charged at the time of purchase and ship when the item becomes available.
Shipping costs are shown at checkout and are calculated per order. We are not responsible for carrier delays, or for loss or damage that occurs in transit once an order has been handed to the carrier, though we will help you resolve carrier issues where we reasonably can. Title and risk of loss pass to you when the carrier receives the package.
All sales are final. Because many items are made to order, we do not accept returns or exchanges except where an item arrives defective or where we sent the wrong item. If that happens, contact us at info@thearticol.com within 7 days of delivery with your order number and a photo, and we will make it right through a replacement or a refund at our discretion.
Creative engagements (such as brand, design, photography, or video work) are governed by a separate proposal, statement of work, or agreement between you and Articol Creative. Where such an agreement conflicts with these Terms for that engagement, the signed agreement controls. Unless your agreement says otherwise, ownership of final deliverables transfers to you upon full payment, and Articol Creative may display completed work in its portfolio and marketing.
The Platform and its content, including text, designs, graphics, logos, the Articol Creative name and brand, written works such as our community letter, and the arrangement of all of it, are owned by Articol Creative or its licensors and are protected by law. You may not copy, reproduce, distribute, or create derivative works from our content without our written permission.
When you submit content to us, for example an answer to our Trust Wall, a message, or a form, you keep ownership of your words. You grant Articol Creative a non-exclusive, royalty-free license to store, display, and share that content in connection with the Platform (for the Trust Wall, publicly, after our review). Do not submit anything unlawful, hateful, harassing, infringing, or that is not yours to share. We may review, edit, decline, or remove any submission at our discretion.
You agree not to misuse the Platform. That includes not using it for any unlawful purpose, not harassing others, not attempting to gain unauthorized access, not scraping or harvesting data by automated means, and not interfering with the Platform's operation or security.
The Platform relies on and may link to third-party services (such as a payment processor, and embedded media or scheduling tools). We are not responsible for the content, policies, or practices of third parties, and your use of their services is subject to their own terms.
The Platform and everything on it are provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement, to the fullest extent permitted by law. We do not warrant that the Platform will be uninterrupted, error-free, or secure.
In no event shall Articol Creative, Inc., its officers, directors, shareholders, members, employees, affiliates, business partners, or associates be held liable for damages exceeding the total amount paid by you as a consumer to Articol Creative in the twelve (12) months preceding the event giving rise to the claim.
To the fullest extent permitted by law, Articol Creative and the parties listed above will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or related to your use of the Platform.
You agree to indemnify and hold harmless Articol Creative, Inc., and its officers, directors, shareholders, members, employees, affiliates, business partners, and associates, from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) that arise from or relate to your use of our business, the Platform, your violation of these Terms, or your violation of any rights of any third party.
This agreement is governed by the laws of the State of Texas, and any dispute shall be resolved in Harris County, Texas. You consent to the exclusive jurisdiction and venue of the state and federal courts located in Harris County, Texas.
We may update these Terms from time to time. When we do, we will change the effective date above, and significant changes take effect when posted. Your continued use of the Platform after an update means you accept the revised Terms.
